Overview

Welcome to Elm Aura. The terms we, us, and our refer to Elm Aura. We operate this website and online store, including all related information, content, features, tools, products and services (the Services). Elm Aura is powered by Shopify, which enables us to provide the Services to you. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

1. Access and Account

Age requirement: You confirm you are at least 18 years old.
Account information: To use the Services you may need to provide personal information (name, email, billing, payment and shipping details). You warrant that information you provide is accurate, current and complete.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. Accounts are non‑transferable.

2. Our Products

Natural materials & variation: Many Elm Aura products use natural or handcrafted materials. Variations in colour, grain, texture, size and pattern are normal and part of the product’s character.
Product descriptions: We aim for accurate descriptions and images but do not guarantee that product appearance on your device will match reality. Product specifications and availability may change without notice.

3. Orders, Cancellation and Statutory Rights

Order acceptance: Placing an order is an offer to purchase. We may accept or decline orders at our discretion. An order is accepted only when we send an order confirmation email.
Consumer rights and cancellation: Nothing in these Terms affects your statutory rights under UK consumer law (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations). For most purchases you have a 14‑day right to cancel (distance selling rules). The cancellation period starts the day after you (or a third party you nominate) receives the goods. To cancel, notify us at sales@elmaura.co.uk or via our contact page. Unless goods are faulty or an exception applies, you are responsible for return postage costs. We will refund you within 14 days of receiving the returned goods or proof of return.
Faulty goods: If goods are faulty you have legal rights under the Consumer Rights Act 2015. You may be entitled to a repair, replacement or refund. Contact us at sales@elmaura.co.uk and we will advise on the returns process.
Personal use: Purchases must be for personal or household use only and not for commercial resale.

4. Prices, VAT and Billing

Currency: Prices are shown in GBP (£).
VAT: Elm Aura is not VAT registered. Prices shown on this site do not include VAT.
Additional charges: Taxes, shipping, customs duties and handling charges may be added at checkout.
Payment: You agree that payment details you provide are accurate and that you are authorised to use the chosen payment method.

5. Shipping, Delivery, Title and Risk

Delivery estimates: Delivery times are estimates only and not guaranteed. We are not liable for carrier or customs delays.
Risk and title: Risk of loss or damage passes to you when we hand the goods to the carrier. Title (ownership) passes to you once we have received full payment for the goods.
Incorrect addresses: You are responsible for providing a correct delivery address. We are not liable for loss due to incorrect address information.
International orders: International shipments may be subject to customs duties or import taxes payable by you.

6. Intellectual Property

Ownership: All content on the Services, including text, graphics, logos, product photography, images, designs and page layout (the Content), is owned by Elm Aura, our licensors, or our suppliers and is protected by UK and international intellectual property laws. Where Content is provided under licence (for example, royalty‑free images, supplier or wholesaler product photography, or other third‑party content), Elm Aura only claims the rights granted to it by those licences and does not represent that it owns such Content.
Licences and warranties: Where we use third‑party images or product photography, we will maintain records of the licence or permission that permits our use. We rely on our licensors and suppliers to provide valid licences; to the extent permitted by law, Elm Aura does not warrant that third‑party content is free from third‑party claims. If you are a rights‑holder and believe your work has been used without permission, please contact us at sales@elmaura.co.uk with details and we will investigate and, where appropriate, remove or disable access to the material.
Attribution and permitted use: Certain third‑party licences may require attribution or restrict commercial use. Where required by licence, we will provide attribution on the relevant product or content page. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Content from the Services except as expressly permitted by these Terms or with our prior written consent.
Takedown and disputes If you believe any Content on the Services infringes your intellectual property rights, please provide a written notice to sales@elmaura.co.uk including: (a) identification of the copyrighted work; (b) location of the infringing material on the Services; (c) your contact details; and (d) a statement that you are the rights‑holder or authorised to act on their behalf. We will respond promptly and may remove or disable access to the material while we investigate.

7. Optional Third‑Party Tools

We may provide access to third‑party tools or integrations. These are provided “as is” and we do not endorse or warrant them. Use of third‑party tools is at your own risk and subject to the third party’s terms.

8. Third‑Party Links

The Services may link to third‑party websites. We are not responsible for their content, accuracy or policies. Interactions with third parties are at your own risk.

9. Relationship with Shopify

Elm Aura is powered by Shopify. All purchases are made directly with Elm Aura. Shopify is not responsible for your transactions with Elm Aura. You release Shopify from claims arising from your purchases.

10. Privacy and Data Protection

UK GDPR: We process personal data in accordance with UK GDPR and the Data Protection Act 2018. For details on the personal data we collect, lawful bases, retention periods and your rights, see our Privacy Policy.
Data transfers: Because our Services are hosted by Shopify, personal data may be transferred outside the UK. We will ensure appropriate safeguards are in place (for example, standard contractual clauses or adequacy decisions) where required.

11. Feedback, Reviews and User Content

By submitting Feedback, reviews, photos or other content you grant Elm Aura a perpetual, worldwide, royalty‑free licence to use, reproduce, modify and publish that content. You represent you own the rights to the content and it does not infringe third‑party rights. We may moderate or remove content at our discretion.

12. Errors, Inaccuracies and Price Corrections

We may correct errors, inaccuracies or omissions and reserve the right to cancel or amend orders if information is inaccurate, including after an order is placed.

13. Prohibited Uses

You must not use the Services to: break the law; infringe IP; harass or defame; upload malware; spam; scrape or harvest data; impersonate others; or otherwise interfere with the Services. We may suspend or terminate accounts that breach these rules.

14. Agents and Automated Access

If you use automated agents, bots or scripts to access the Services they must identify themselves and comply with our requirements. We may limit or block agent access.

15. Termination

We may suspend or terminate access to the Services at our discretion. You remain liable for amounts due up to termination. Sections that by their nature survive termination (IP, liability, indemnity, etc.) will continue to apply.

16. Disclaimer of Warranties

The Services and products are provided “as is” and “as available”. We do not guarantee uninterrupted or error‑free service. This disclaimer does not affect your statutory rights under UK consumer law.

17. Limitation of Liability

To the fullest extent permitted by law, Elm Aura will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services. Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

18. Indemnification

You agree to indemnify and hold harmless Elm Aura, Shopify and their affiliates from claims arising from your breach of these Terms, your misuse of the Services, or your violation of law or third‑party rights.

19. Severability

If any provision is found unenforceable, the remainder of the Terms will continue in full force.

20. Waiver; Entire Agreement

Failure to enforce a right is not a waiver. These Terms and any policies posted on the site constitute the entire agreement between you and Elm Aura.

21. Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights without notice.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You and Elm Aura agree to submit to the exclusive jurisdiction of the courts of England and Wales.

23. Complaints and Dispute Resolution

Contact us first: For complaints, email sales@elmaura.co.uk. We aim to respond within 14 days.
Alternative dispute resolution: If we cannot resolve your complaint you may be able to use an ADR scheme or the UK courts. For cross‑border EU purchases, the EU ODR platform may be available.

24. Sustainability and Environmental Claims

Elm Aura aims to be transparent about sustainability. Any environmental claims we make comply with the UK CMA Green Claims Code and are supported by verifiable evidence. If we make specific claims (e.g., recycled content, carbon offset), we will provide supporting information on our Sustainability page.

25. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in accordance with applicable law. Continued use of the Services after changes constitutes acceptance.
